These Terms and Conditions (“Terms”, “Terms and Conditions”) govern your relationship with www.aspyhairextensions.com website (the “Service”) operated by Aspy Hair Extensions (“us”, “we”, or “our”).
Please read these Terms and Conditions carefully before using the Service. Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
If you wish to purchase any product available through the Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.
You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.
By submitting such information, you grant us the right to provide the information to third parties for purposes of facilitating the completion of Purchases.
We reserve the right to refuse or cancel your order at any time for certain reasons including but not limited to product or availability, errors in the description or price of the product , error in your order or other reasons.
RETURN AND REFUNDS POLICY
Exchanges and Returns
Due to the nature of our product and it’s intended use we regret that we do not accept returns or exchange stock. The hair is guaranteed for use when carrying out the correct installation, aftercare procedures and maintenance. Please choose carefully because, for hygiene reasons and customer safety, we are unable to offer refunds or returns on any hair extensions for a change of mind.
We do not offer order cancellation. Once the customer has paid for their order, it cannot be cancelled.
Prices and special offers are correct at the time of goods being displayed on this site only, and are subject to alteration without notice.
Colour rings are offered as a guide only, and due to the nature of our hair being a natural product, will be subject to variation.
All colours are represented as closely as possible – to aid selection using electronic screens and monitors. Displays and resolutions can affect how these appear on screen and Aspy Hair Extensions cannot accept responsibility where these may vary from the actual product.
SHIPPING AND DELIVERY
Orders are processed chronologically. Processing times are 2-7 days depending on the chosen order color. Each set of extensions are manufactured specifically for each customer. Once the customer's oder has been processed, the package will be shipped through Fedex arriving in 2-3 working days.
In the event that we happen to be out of stock, we will source your backorder within 7-10 working days or sooner and immediately dispatch your paid-up order upon our receipt thereof. Orders are only sent on paid invoices.
Aspy Hair Extensions will not be held responsible for the loss of any parcels in transit or any delay in delivery caused by the delivery company or any of its staff as well as delays experienced at customs due to random checks and inspections.
NO REFUNDS will be given due to a delay of delivery if the delay is due to customs inspections, as it is out of our hands when these checks are done.
Aspy Hair Extensions will not be held responsible for any injuries or damages arising from the fitment of extensions by other hair extensionists. Please ensure a professional installs your hair extensions. We can accept no liability for any damage caused by a salon or third party as this fall within the jurisdiction of the extensionist/salon and client contract and is, therefore, the responsibility of the extensionist/salon.
Incorrect Delivery Information
Please make sure you enter the correct delivery address details when making an order. Aspy Hair Extensions shall not be held liable for incorrect details entered by the customer. In the unfortunate circumstance when an item is delivered to an incorrect or incomplete address, we are under no obligation to issue a refund or send a replacement of goods.
CONTESTS, SWEEPSTAKES AND PROMOTIONS
The Service and its original content, features and functionality are and will remain the exclusive property of Aspy Hair Extensions and its licensors. The Service is protected by copyright, trademark, and other laws of Canada. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Aspy Hair Extensions.
DEFECTIVE PRODUCT CLAIM
Please be advised that any application of hair color, toners, purple shampoos, or chemical treatments on ASPY Hair Extensions will prohibit the customer from filing a defective product claim request.
The claim must be made within 30 days of the purchase date or if the date the customer received the package if it is later than the purchase date. Any claims after the 30 day mark, will be not be eligable for the defective product claim.
Any other product alteration or using a non-ASPY Hair Extensions products or accessory (e.g., not using ASPY Hair Extensions Weave Bye remover, Re-Tape Tabs, ASPY mend + extend shampoo and conditioner, and ASPY brush will prohibit the customer from filing a defective product claim request. Customer must be able to provide receipts for proof of purchase. Failure to provide receipts for proof of purchase will prohibit the customer from filing a defective product claim request.
For any defective product claim, you must return at least 50% of the hair for inspection. The hair will be inspected and evaluated to determine if it was a factory defect or misuse of the product by the customer. To be eligible for our hair concern claims, you must have purchased our products directly from www.aspyhairextensions.com or from the ASPY retail location at 653 Topsail Road in St. John's, NL. ASPY will contact the customer within 30 business days to confirm if the product was a factory defect or misuse of the product by the customer. If deemed a manufacturer defect, the customer will receive replacement hair in the exact products of the original order. If deemed misuse of product by the customer , the case will be closed and no new hair will be provided.
Active claims that have no actions taken, meaning they do not provide 50% of the hair, by the person who filed it within 30 days will be considered abandoned and will be closed. The date of last contact will determine the close date. Claims cannot be reopened.
LINKS TO OTHER WEB SITES
Our Service may contain links to third-party web sites or services that are not owned or controlled by Aspy Hair Extensions. Aspy Hair Extensions has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Aspy Hair Extensions shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services. We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.
We may terminate or suspend your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.
These Terms shall be governed and construed in accordance with the laws of Canada, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
